Commissions & Fees

At Properties Clovis, we believe that the quality of the service deserves fair, transparent and adapted remuneration. Our fees are always discussed with the principal when signing the warrant, and can be reassessed when negotiating with a serious buyer.

Freedom of honoraria in France

In France, Real estate agents' fees are free. They are agreed between the real estate agent and his principal — whether it is a seller within the framework of a sales mandate, or acquirer under a research mandate.

At Properties Clovis, this freedom is an opportunity: to build a relationship of trust with you, based on transparency and fairness. Each mandate is unique — Every commission is, too.

The real estate mandate

In accordance with Decree No. 72-678 of 20 July 1972 — Article 72 : the holder of the professional card bearing the mention « Real estate and commercial transactions » cannot negotiate or engage in a transaction without having a written mandate issued by one of the parties.

  • Formalizes the tasks entrusted to the Agency
  • Specify the amount of fees and how they are calculated
  • Secure transaction for seller and buyer

The committee is usually charged with the owner seller or the principal (in the case of a search warrant). Any provision to the contrary must be expressly mentioned in the written mandate.

No fee without sale. Pursuant to Article 6 of Law No 70-9 of 2 January 1970 (Law Hoguet), no remuneration may be received before the transaction is actually concluded and evidenced by a written act containing the commitment of the parties.

Percentage

5% to 8% VAT
Minimum chargeable: 15,000 € TTC
Benefits
  • Fees proportional to the value of the property — the agent is fully motivated
  • Trading margin — a well sized commission absorbs a price drop without penalising the seller
  • Most common formula — readable and reassuring for all parties
Example: Presented at the Public FCC Award of 890,000 € commission of 6% TTC → net selling price in case of sale without decrease : 839 622 € — Committee: 50 378 € TTC
Form B

Flat rate commission until sale

Ceiling at 8% TTC
Minimum chargeable: 15,000 € TTC
Benefits
  • Total visibility from the start — the seller knows exactly the cost of the service
  • No bad surprise when negotiating — the package remains the same regardless of the final price
  • Adapted to atypical or complex goods whose valuation is difficult to predict
  • Secure the agent for the duration — commitment until sale
Example: Well at 500,000 € Net seller — package 8 % = 40 000 € TTC
Price displayed in advertising, agency fees included : 540 000 €
In both formulas: commission due only in the event of a successful sale — in accordance with Article 6 of Law No 70-9 of 2 January 1970. Commission is usually the responsibility of the seller or principal, unless otherwise stipulated. Formula chosen by mutual agreement between Clovis Properties and the principal.

Mandate

Defining a balanced committee

We do not work with low commissions (2 – 4%) in principle. This approach limits any room for manoeuvre in the negotiation phase.

With too low a commission initially positioned on the mandate, the real estate agent no longer has any room for manoeuvre to round the angles or make a commercial gesture at the decisive moment. We showcase our services to ensure a transaction balanced for the owner and the buyer.

Regulatory framework

In accordance with Decree No. 72-678 of 20 July 1972, any professional bearing the mention « Real estate and commercial transactions » cannot negotiate or engage without holding a written warrant issued in advance by one of the parties.

Inter-cabinet & mandate delegation

Properties Clovis is open to collaboration with all professionals in the sector: agencies, agents, independent commercial agents. We exercise our mandate in a spirit of trust, mutual respect and transparency.

  • Commission sharing: usually 50/50except for specific agreement negotiated over-the-counter
  • The delegation may be or by email, in accordance with the judgment of the Court of Cassation of 9 January 2019 (No.17-27841)
Law Hoguet & professionnels : the Hoguet law has as its primary vocation the consumer protection. Between professionals, it does not apply under the same conditions. A mandate delegation can be done orally or by email. The registration of warrants is subject to the obligation of principal or delegating agent — it is not an obligation for the delegated representative.

Value Reviews & Market Research

Whatever kind of property — in France or internationally — Properties Clovis realizes a value notice or an in-depth market study to determine a marketing price consistent with market reality.

Our method: analysis of goods currently on sale that may compete with the object of the demand, verification of multiple data sources, local or international context study. No on-site travel.
